Normativas de Reaseguro en Brasil
Síntesis – 1er Anticipo

La Ley Complementaria Nº 126 del 15 de enero de 2007, determinó el fin del monopolio, ejercido por el Instituto de Resseguros do Brasil (IRB) por más de 6 décadas, y creó una reserva de mercado para los reaseguradores que se establecieron en el país. Esta ley fue regulada por el Conselho Nacional de Seguros Privados (CNSP) a través de la Resolución Nº 168 del 17 de diciembre de 2007, la cual entró en vigor el 15 de abril de 2008.

La ley estableció la clasificación de los reaseguradores en tres categorías: reaseguradores locales, admitidos y eventuales. Los reaseguradores locales son aquellos establecidos en el país en forma de sociedad anónima para ejecutar operaciones de reaseguro y retrocesión exclusivamente. Los admitidos son aquellas empresas con sede en el exterior pero con oficina de representación en Brasil, estos se ciñen a las exigencias detalladas por la Resolución CNSP Nº 168 y tienen que estar debidamente registradas en la Superintendência de Seguros Privados (SUSEP). Las eventuales se definen como aquellas que tienen sede en el exterior sin oficina de representación en Brasil, ratificando a las mismas exigencias expresadas por aquella resolución y registradas ante la SUSEP como tales.

Sin embargo, ocurre que en Brasil nada es perenne o definitivo en términos de legislación, por lo que el país es evaluado de forma bastante negativa cuando se analiza el clima para hacer inversiones. De este modo, la Resolución Nº 225/2010 vino a ser modificada por la nueva Resolución CNSP Nº 325 del 30 de julio de 2015. Esta resolución ha ratificado la obligatoriedad de la contratación obligatoria pero presentando una escala decreciente para esta obligatoriedad.

El artículo 15 quedó redactado de la siguiente manera:

-La sociedad aseguradora ofrecerá preferentemente a reaseguradores locales, al menos, el 40% (cuarenta por ciento) de su cesión de reaseguro a cada contrato Automático o Facultativo.

-Párrafo único -A los efectos del porcentaje establecido en este artículo, la aseguradora deberá contratar obligatoriamente, como mínimo, los siguientes porcentajes de cesión de reaseguro para reaseguradores locales a cada contrato Automático o Facultativo:
 
I - 40% (cuarenta por ciento) hasta el 31 de diciembre de 2016.
II - 30% (treinta por ciento) a partir del 1º de enero de 2017.
III - 25% (veinticinco por ciento) a partir del 1º de enero de 2018.
IV - 20% (veinte por ciento) a partir del 1º de enero de 2019.
V - 15% (quince por ciento) a partir del 1º de enero de 2020.

También se modificaron los porcentajes de retrocesión intragrupo que eran del 20% elevándolos a partir del 01/01/17 a 30% hasta llegar al 01/01/20 al 75%. O sea que a partir del 2020 la reserva de mercado será del 15% y la posibilidad de retrocedentes al intragrupo al 75%.

El mercado reasegurador brasilero se compone por:
-16 reaseguradoras locales (5 de capital nacional).
-38 reaseguradoras admitidas más Lloyd’s (con 100 sindicatos inscriptos).
-77 reaseguradoras eventuales.
-26 corredores de reaseguros.

Complementary Law No. 126 dated January 15, 2007, determined the end of this monopoly, exercised by the Instituto de Resseguros do Brasil (IRB) for more than 6 decades, and created a market reserve for reinsurers established in the country. This law was regulated by the Conselho Nacional de Seguros Privados (CNSP) through Resolution No. 168 of December 17, 2007, which entered into force on April 15, 2008.

The law established the classification of reinsurers into three categories: local, admitted and eventual reinsurers. Local reinsurers are those established in the country, in the form of a corporation, to perform exclusively reinsurance and retrocession operations. The admitted reinsurers are those companies headquartered abroad, with representative office in Brazil, meeting the requirements detailed by CNSP Resolution No. 168 and duly registered with the Superintendência de Seguros Privados (SUSEP). The eventual reinsurers are defined as those that are based abroad, without representation office in Brazil, meeting the same requirements expressed by that resolution and registered with SUSEP as such.

However, in Brazil nothing is permanent or permanent in terms of legislation, which is why the country is evaluated very negatively when analyzing the environment to do business. Accordingly, the aforementioned Resolution No. 225/2010 was amended by a new CNSP Resolution No. 325 dated July 30, 2015. It reinstated the institute of preferential supply, ratifying the compulsory contracting obligation, but presenting a decreasing scale for this obligation.

Article 15 is now worded as follows:

-The insurance company will preferentially offer local reinsurers at least 40% (forty percent) of their reinsurance cessions to each Automatic or Facultative contract.

-Sole Paragraph - For the purposes of the percentage established in this article, the insurer shall obligatorily contract, at least, the following percentages of assignment of reinsurance to local reinsurers for each Automatic or Facultative contract:

I - 40% (forty percent) until December 31, 2016.
II - 30% (thirty percent) as of January 1st, 2017.
III - 25% (twenty five percent) as of January 1st, 2018.
IV - 20% (twenty percent) as of January 1st, 2019.
V - 15% (fifteen percent) as of January 1st, 2020.

The intra-group retrocession rates were also modified, which were 20%, increasing them from 01/01/17 to 30% until 01/01/20 to 75%. So that from 2020 the market reserve will be 15% and the possibility of backslipping to the intragroup to 75%.

The Brazilian reinsurance market consists of:
-16 local reinsurers (5 national capital).
-38 reinsurers admitted plus Lloyd's (with 100 registered unions).
-77 eventual reinsurers.
-26 reinsurance brokers.
