Normativas de Reaseguro en Chile:
Normas para Contratación y Gestión

El reaseguro de los contratos celebrados en Chile debe hacerse con compañías de seguros y de reaseguros constituidas en Chile autorizadas para operar en el país. Las entidades reaseguradoras constituidas en Chile sólo podrán reasegurar riesgos del primer grupo (riesgo de pérdida o deterioro en las cosas o en el patrimonio) o del segundo (riesgos de las personas o que garanticen dentro o al término de un plazo, un capital o una renta); pudiendo operar en ambos grupos siempre que constituyan capitales y contabilidades independientes y separadas para cada uno de ellos.

7. REASEGUROS

7.1. Entidades extranjeras de reaseguros
 Están facultadas para realizar operaciones de reaseguros en Chile las entidades extranjeras que cumplan con los siguientes requisitos:
a) Encontrarse clasificadas por agencias clasificadoras de riesgo, de reconocido prestigio internacional a juicio de la Superintendencia, en a lo menos categoría de riesgo BBB o su equivalente.
b) Designar un representante en Chile, el que las representará con amplias facultades, pudiendo incluso ser emplazado en juicio. No obstante lo anterior, no será necesaria la designación de un representante, si el reaseguro se efectúa a través de un corredor de reaseguro inscrito en la Superintendencia.

7.2. Corredores de Reaseguros
Pueden operar en reaseguros los intermediarios o corredores de reaseguros, nacionales o extranjeros, que cumplan los siguientes requisitos:
a) Inscripción en el Registro que lleva la Superintendencia.
b) Contratación de póliza de seguro de Errores y Omisiones sin deducible, por monto no inferior a UF 20.000 (USD 592.8292 ) ó 1/3 de la prima intermediada en el año anterior, la que sea más alta, para responder del correcto y cabal cumplimiento de todas las obligaciones emanadas de su actividad y de los perjuicios que puedan ocasionar a los que contraten por su intermedio.
c) Tratándose de extranjeros, ser persona jurídica, constituida legalmente en su país de origen, con capacidad para intermediar riesgos cedidos desde el exterior y pagar compromisos en moneda de libre convertibilidad.

8. RESERVAS TECNICAS

Las entidades aseguradoras y reaseguradoras establecidas en el país deben constituir, en conformidad a procedimientos, tablas de mortalidad, tasas de interés técnico y otros aspectos fijados por la Superintendencia, las siguientes reservas técnicas:
a) Reserva riesgo en curso: para hacer frente a obligaciones de una compañía con asegurados, originadas por primas de contratos de seguros de corto plazo.
b) Reserva matemática: para hacer frente a las obligaciones de una compañía del segundo grupo con los asegurados, originadas por primas de contrato de seguros de largo plazo (períodos superiores a un año).
c) Reserva de siniestros: para hacer frente a obligaciones por siniestros ocurridos, pendientes de pago, y por los ocurridos y no reportados.
d) Reserva adicional a la de riesgo en curso: para hacer frente a obligaciones por riesgos cuya siniestralidad es poco conocida, altamente fluctuante, cíclica o catastrófica, que sea necesaria formar para el normal desenvolvimiento de la actividad aseguradora o reaseguradora, o la que puede exigir la Superintendencia de Valores y Seguros por riesgo de mercado de inversiones.
e) Reserva de descalce, por los riesgos originados en el descalce de plazo, tasa de interés, moneda e instrumentos de inversión, entre los activos y pasivos de la compañía.
f). Reserva de valor del fondo, en la parte que corresponda a las obligaciones generadas por las cuentas de inversión en los seguros del segundo grupo que las contemplen.

9. NORMAS DE INVERSION

 9.1. Inversiones
 Las reservas técnicas y el patrimonio de riesgo de las entidades aseguradoras y reaseguradoras, sin perjuicio de los depósitos que mantengan en cuenta corriente, deberán estar respaldados por inversiones efectuadas en los siguientes instrumentos y activos: 1. Inversiones de Renta Fija:
 a) Títulos emitidos o garantizados hasta su total extinción por el Estado o emitidos por el Banco Central de Chile;
b) Depósitos a plazo, letras de crédito hipotecarias, bonos y otros títulos de deuda o crédito, emitidos por bancos e instituciones financieras;
c) Bonos, pagarés y otros títulos de deuda o crédito, emitidos por empresas públicas o privadas;
d) Participación en convenios de créditos en los que concurran dos o más bancos o instituciones financieras, conforme a las normas de carácter general que dicte la Superintendencia, debiendo contemplarse en éstas el riesgo de crédito del deudor.
e) Mutuos hipotecarios endosables, de los señalados en el Título V del D.F.L. Nº 251 de 1931.
2. Inversiones de Renta Variable:
 a) Acciones de sociedades anónimas abiertas y acciones de empresas concesionarias de obras de infraestructura de uso público;
b) Cuotas de fondos mutuos cuyos activos se encuentren invertidos en valores o activo nacionales;
c) Cuotas de fondos de inversión, cuyos activos se encuentren invertidos en valores o activos nacionales.
3. Inversiones en el exterior:
 a) Títulos de deuda o crédito, emitidos o garantizados hasta su total extinción por Estados o Bancos Centrales extranjeros;
b) Depósitos, bonos, pagarés y otros títulos de deuda o crédito, emitidos por instituciones financieras, empresas o corporaciones extranjeras o internacionales;
c) Acciones de sociedades o corporaciones constituidas fuera del país;
d) Cuotas de fondos mutuos o de inversión constituidos fuera del país;
e) Cuotas de fondos mutuos o de inversión constituidos en el país, cuyos activos estén invertidos en valores extranjeros. f) Bienes raíces no habitacionales situados en el exterior.
 4. Bienes raíces no habitacionales, cuya tasación comercial sea practicada al menos cada dos años, según norma de carácter general que dicte la Superintendencia.
5. Otros Activos.
a) Crédito no vencido por primas no devengadas otorgado a los asegurados, provenientes de contratos de seguro con cláusula de resolución por no pago de prima, para respaldar el total de la reserva de riesgo en curso y hasta el 10% del patrimonio de riesgo, de las compañías aseguradoras del primer grupo;
b) Siniestros por cobrar no vencidos, producto de las cesiones efectuadas a los reaseguradores, para respaldar el total de la reserva de siniestros y hasta el 10% del patrimonio de riesgo, salvo aquellos siniestros provenientes de las cesiones indicadas en el artículo 20 del D.F.L. Nº 251, que no se puedan descontar de la reserva, conforme lo señalado en dicho artículo;
c) Crédito no vencido por primas producto de los seguros de invalidez y sobrevivencia del decreto ley Nº 3.500, de 1980, para respaldar el total de la reserva de siniestros, para las compañías del segundo grupo;
d) Avance a tenedores de sus pólizas de seguros de vida, hasta por el monto del valor de rescate de ellas, siempre que en dichas pólizas se indique expresamente que el empréstito podrá deducirse del monto de la indemnización a pagar en virtud de lo establecido en la póliza o en sus adicionales, si corresponde.
e) Crédito no vencido por prima no devengada otorgado a las compañías cedentes del primer grupo en virtud de contratos de reaseguro, para respaldar hasta el total de las reservas de riesgo en curso,
 f) Crédito no vencido por prima devengada otorgado a las compañías cedentes del primer grupo en virtud de contratos de reaseguro, para respaldar hasta el total de las reservas de siniestros.
6. Productos derivados financieros, conforme a los límites y condiciones que establezca la Superintendencia, por norma de carácter general. El límite máximo de inversión que fije la Superintendencia, no podrá ser inferior a un 0,5% ni superior a un 3% de las reservas técnicas y patrimonio de riesgo de las compañías.
9.2. Requisitos y diversificación de las inversiones
 La inversión en los distintos tipos de instrumentos o activos representativos de reservas técnicas y patrimonio de riesgo, señalados en el artículo 21, estará sujeta a los siguientes límites máximos:
 1. Límites por Instrumento.
a) 5% del total, para la suma de la inversión en los instrumentos de la letra c) del Nº 1, que no se encuentren inscritos en el Registro de Valores de la Superintendencia, o que estando inscritos, no cuenten con clasificación de riesgo conforme a la ley Nº 18.045, o ésta sea inferior a BBB o N-3, según corresponda. Se exceptuarán de este límite, aquellos instrumentos emitidos por empresas nacionales, fuera del país, que cuenten con clasificación de riesgo internacional igual o superior a BBB;
 b) entre un 3% y un 5% del total, según lo establezca la Superintendencia por norma de carácter general, para la suma de la inversión en los instrumentos de la letra d) del Nº 1;
 c) 30% del total, en aquellos instrumentos de la letra e) del Nº 1, para compañías del segundo grupo, y 30% sólo del patrimonio de riesgo, para compañías del primer grupo;
 d) 40% del total para la suma de la inversión en instrumentos del Nº2;
e) 5% del total, en aquellos instrumentos de la letra a) del Nº2, que no cumplan el requisito de presencia bursátil que establezca, por norma de carácter general, la Superintendencia;
f) 10% del total, en aquellos fondos de inversión de la letra c) del Nº2;
g) 20% del total, para la suma de la inversión en aquellos instrumentos del Nº3;
 h) 5% del total, para la suma de la inversión en los instrumentos de las letras a) y b) del Nº3, que presenten clasificación de riesgo internacional, inferior a BBB o N-3, o su equivalente según corresponda a instrumentos de largo y corto plazo, respectivamente; i) 10% del total, para la suma de la inversión en instrumentos de las letras c), d), y e) del Nº3;
 j) 3% del total en aquellos activos de la letra f) del Nº3, y
 k) 20% del total, en aquellos activos del Nº4, para compañías del segundo grupo, y 30% sólo del patrimonio de riesgo, para compañías del primer grupo.
2. Límites conjuntos.
a) 25% del total, para la suma de la inversión en aquellos instrumentos comprendidos en las letras b) y c) del Nº1, que presenten clasificación de riesgo igual o inferior a BBB o N-3, según corresponda a instrumentos de largo y corto plazo, o que, en el caso de instrumentos de la letra c) del Nº1, no presenten clasificación de riesgo;
b) entre un 10% y un 20% del total, según lo establezca la Superintendencia por norma de carácter general, para la suma de la inversión en los instrumentos comprendidos en las letras b), c) y d) del Nº1, y a) del Nº2, emitidos por sociedades anónimas, bancos, instituciones financieras y empresas pertenecientes a un mismo grupo empresarial. Este límite se rebajará a la mitad, si la compañía inversionista forma parte del grupo empresarial;
c) 10% del total, para la suma de la inversión en los instrumentos comprendidos en las letras b), c) y d) del Nº1 y a) del Nº2, emitidos o garantizados por una misma entidad, o sus respectivas filiales. Este límite se rebajará a la mitad, si la compañía inversionista forma parte del grupo empresarial al que pertenece el emisor;
d) 40% del total, para la suma de la inversión en instrumentos de las letras e) del Nº1, fondos de inversión de la letra c) del Nº2, en cuanto inviertan en activos señalados en los números 10, 11, 12, 13 y 15 del artículo 5º de la ley Nº18.815, bienes raíces del Nº4, y bonos o pagarés de la letra c) del Nº1, emitidos por sociedades securitizadoras de las señaladas en el Título XVIII de la ley Nº18.045, que estén respaldados por títulos de crédito transferibles, relacionados con el sector inmobiliario, para compañías del segundo grupo, y 50% sólo del patrimonio de riesgo, para compañías del primer grupo;
e) 5% del total, para la suma de la inversión en los instrumentos comprendidos en las letras b) y c) del Nº3, emitidos o garantizados por una misma entidad. Este límite se rebajará a la mitad, cuando el emisor sea persona relacionada a la compañía, y
 f) 10% del total, para la suma de la inversión en fondos señalados en las letras b) y c) del Nº2 y e) del Nº3, administrados por una misma entidad administradora de fondos mutuos o de inversión. La Superintendencia, mediante norma de carácter general, podrá establecer límites de diversificación por emisión, a las inversiones que respaldan las reservas técnicas y el patrimonio de riesgo indicados en el artículo 21 del D.F.L. Nº 251, considerando los siguientes rangos: a) Entre un 10% y un 20% del total de los depósitos y captaciones y del total de letras hipotecarias emitidas por un banco o entidad financiera, en el caso de los instrumentos de la letra b) del 4Nº1; b) Entre un 20% y un 30% de la emisión o serie, en el caso de instrumentos de la letra c) del Nº 1; c) Entre un 10% y 20% de la participación, en el caso de instrumentos de la letra d) del Nº1; d) Entre un 8% y un 20% del total de acciones suscritas, en el caso de instrumentos de la letra a) del Nº2, y e) Entre un 20% y un 30% del total de cuotas suscritas de un fondo mutuo o de inversión, señalados en las letras b) y c) del Nº2 y d) y e) del Nº3. La Superintendencia fijará los límites señalados por períodos mínimos de un año, debiendo informar la modificación de éstos, con tres meses de anticipación a su vigencia. Si una inversión representativa de reservas técnicas o de patrimonio de riesgo o un conjunto de ellas sobrepasaren alguno de los límites de diversificación establecidos en esta ley, el exceso no será aceptado como respaldo de dichas reservas ni del patrimonio de riesgo. Tampoco serán aceptadas aquellas inversiones que dejaren de cumplir los requisitos señalados en la ley para ser representativas de reservas técnicas. Las inversiones representativas de reservas técnicas y de patrimonio de riesgo no podrán estar afectadas a gravámenes, prohibiciones, embargos, litigios, medidas precautorias, condiciones suspensivas o resolutorias, ni ser objeto de ningún otro acto o contrato que impida su libre cesión o transferencia. En el evento de que alguna inversión se viere afectada en la forma señalada, no podrá ser considerada como representativa de reservas técnicas ni de patrimonio de riesgo.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Reinsurance Regulations in Chile:
Rules for Contracting and Management

The reinsurance of contracts entered into in Chile must be done with insurance and reinsurance companies incorporated in Chile authorized to operate in the country. Reinsurance entities incorporated in Chile may only reinsure risks of the first (risk of loss or deterioration in things or in property) or second group (people risk or that guarantee inside or outside term, capital or income); being able to operate in both groups as long as they constitute independent and separate capitals and accounting for each one of them.

7. REINSURANCE

7.1. Foreign Reinsurance Entities
 Foreign entities that comply with the following requirements are authorized to carry out reinsurance operations in Chile:
a) To be classified by risk rating agencies, of recognized international prestige in the opinion of the Superintendency, in at least the BBB risk category or its equivalent.
b) Appoint a representative in Chile, who will represent them with broad powers, and may even be summoned in court. Notwithstanding the foregoing, the appointment of a representative will not be necessary if the reinsurance is made through a reinsurance broker registered with the Superintendency.

7.2. Reinsurance Brokers
Reinsurance intermediaries or brokers, national or foreign, that meet the following requirements may operate in reinsurance:
 a) Registration in the Registry maintained by the Superintendency. b) Hiring of Errors and Omisions insurance policy, without deductible, for an amount not less than UF 20,000 (USD 592.8292) or 1/3 of the premium intermediated in the previous year, whichever is higher, to answer for the correct and full compliance of all the obligations arising from its activity and the damages that may be caused to those who hire through it.
c) In the case of foreigners, be a legal entity, legally incorporated in their country of origin, with the capacity to intermediate risks transferred from abroad and pay commitments in freely convertible currency.

8. TECHNICAL RESERVATIONS

The insurers and reinsurers established in the country must establish, in accordance with procedures, mortality tables, technical interest rates and other aspects set by the Superintendency, the following technical reserves:
 a) Reserve risk in progress: to meet the obligations of a company with insured persons, originated by premiums of short-term insurance contracts.
b) Mathematical reserve: to meet the obligations of a company of the second group with the insured, originated by long-term insurance contract premiums (periods greater than one year).
c) Reserve of claims: to meet obligations for losses that have occurred, pending payment, and for those that occurred and not reported.
 d) Additional reserve to the risk in progress: to meet obligations for risks whose accident rate is little known, highly fluctuating, cyclical or catastrophic, that it is necessary to train for the normal development of the insurance or reinsurance activity, or the one that can Demand the Superintendence of Securities and Insurance for investment market risk.
e) Reserve of mismatch, for the risks originated in the mismatch of term, interest rate, currency and investment instruments, among the assets and liabilities of the company.
 F). Reserve the value of the fund, in the part that corresponds to the obligations generated by the investment accounts in the insurance of the second group that contemplate them.

9. INVESTMENT RULES

9.1. Investments

 The technical reserves and the risk equity of the insurance and reinsurance entities, without prejudice to the deposits held in the current account, must be backed by investments made in the following instruments and assets: 1. Fixed Income Investments:
a) Securities issued or guaranteed until their total extinction by the State or issued by the Central Bank of Chile;
b) Term deposits, mortgage letters of credit, bonds and other debt or credit securities issued by banks and financial institutions;
c) Bonds, promissory notes and other debt or credit securities issued by public or private companies;
d) Participation in credit agreements in which two or more banks or financial institutions attend, in accordance with the general regulations issued by the Superintendency, and the debtor's credit risk must be considered in them.
 e) endorsable mortgage loans, as indicated in Title V of the D.F.L. No. 251 of 1931.
2. Variable Income Investments:
a) Stocks of public limited companies and shares of concession companies of infrastructure works for public use;
b) Quotas of mutual funds whose assets are invested in national securities or assets;
c) Quotas of investment funds, whose assets are invested in national securities or assets.
3. Investments abroad:
a) Debt or credit securities, issued or guaranteed until their total extinction by foreign States or Central Banks;
b) Deposits, bonds, promissory notes and other debt or credit securities issued by foreign or international financial institutions, companies or corporations;
 c) Shares of companies or corporations incorporated outside the country;
 d) Quotas of mutual funds or investment set up outside the country; e) Quotas of mutual funds or investment constituted in the country, whose assets are invested in foreign securities.
f) Non-residential real estate located abroad.
4. Non-residential real estate, whose commercial appraisal is practiced at least every two years, according to the general norm dictated by the Superintendency.
5. Other Assets.
a) Credit not due for unearned premiums granted to the insured, from insurance contracts with resolution clause for non-payment of premium, to support the total of the risk reserve in progress and up to 10% of the risk equity, of the insurance companies of the first group;
b) Uncollected claims receivable, as a result of the assignments made to the reinsurers, to support the total loss reserve and up to 10% of the risk equity, except for those losses arising from the assignments indicated in Article 20 of the D.F.L. No. 251, which can not be deducted from the reserve, as indicated in said article;
 c) Credit not due for premiums resulting from the disability and survivorship insurance of Decree-Law No. 3,500, of 1980, to support the total claims reserve for the companies of the second group;
d) Progress to holders of their life insurance policies, up to the amount of the redemption value of them, provided that said policies expressly state that the loan may be deducted from the amount of the indemnity to be paid pursuant to the provisions of the policy or its additional, if applicable.
e) Credit not due for unearned premium granted to the companies that sold the first group under reinsurance contracts, to support up to the total risk reserves in progress,
f) Credit not due for accrued premium granted to the companies that sold the first group under reinsurance contracts, to support up to the total reserves of claims.
6. Financial derivative products, according to the limits and conditions established by the Superintendency, by general rule. The maximum investment limit established by the Superintendency may not be less than 0.5% nor more than 3% of the technical reserves and risk equity of the companies.
9.2. Requirements and diversification of investments
The investment in the different types of instruments or assets representative of technical reserves and risk equity, indicated in article 21, will be subject to the following maximum limits:
1. Limits per Instrument.
a) 5% of the total, for the sum of the investment in the instruments of letter c) of No. 1, that are not registered in the Securities Registry of the Superintendency, or that, if they are registered, do not have a risk classification according to law No. 18,045, or it is lower than BBB or N-3, as appropriate. Excepted from this limit are those instruments issued by national companies, outside the country, that have an international risk rating equal to or greater than BBB;
b) between 3% and 5% of the total, as established by the Superintendency by general rule, for the sum of the investment in the instruments of letter d) of No. 1;
c) 30% of the total, in those instruments of letter e) of No. 1, for companies of the second group, and 30% only of the risk assets, for companies of the first group;
d) 40% of the total for the sum of the investment in instruments of Nº2;
e) 5% of the total, in those instruments of letter a) of Nº2, that do not comply with the requisite of stock presence that establishes, by norm of general character, the Superintendency;
 f) 10% of the total, in those investment funds of letter c) of Nº2;
g) 20% of the total, for the sum of the investment in those instruments of Nº3;
h) 5% of the total, for the sum of the investment in the instruments of letters a) and b) of Nº3, that present an international risk classification, lower than BBB or N-3, or its equivalent as it corresponds to long instruments. and short term, respectively;
 i) 10% of the total, for the sum of the investment in instruments of letters c), d), and e) of Nº3;
j) 3% of the total in those assets of letter f) of Nº3, and
k) 20% of the total, in those assets of Nº4, for companies of the second group, and 30% only of the risk assets, for companies of the first group.
2. Joint limits.
a) 25% of the total, for the sum of the investment in those instruments included in letters b) and c) of No. 1, which present risk classification equal to or less than BBB or N-3, as appropriate for long and short instruments term, or that, in the case of instruments of letter c) of Nº1, do not present a risk classification;
b) between 10% and 20% of the total, as established by the Superintendency by general rule, for the sum of the investment in the instruments included in letters b), c) and d) of No. 1, and a) of the Nº2, issued by corporations, banks, financial institutions and companies belonging to the same business group. This limit will be reduced by half, if the investment company is part of the business group;
 c) 10% of the total, for the sum of the investment in the instruments included in letters b), c) and d) of Nº1 and a) of Nº2, issued or guaranteed by the same entity, or their respective subsidiaries. This limit will be reduced by half, if the investment company is part of the business group to which the issuer belongs;
d) 40% of the total, for the sum of the investment in instruments of letters e) of Nº1, investment funds of letter c) of Nº2, as soon as they invest in assets indicated in numbers 10, 11, 12, 13 and 15 of article 5 of law No. 18,815, real estate of No. 4, and bonds or promissory notes of letter c) of No. 1, issued by securitization companies of those indicated in Title XVIII of Law No. 18,045, which are backed by for transferable credit titles, related to the real estate sector, for companies of the second group, and 50% only of the risk assets, for companies of the first group; e) 5% of the total, for the sum of the investment in the instruments included in letters b) and c) of Nº3, issued or guaranteed by the same entity. This limit will be reduced by half, when the issuer is a person related to the company, and
f) 10% of the total, for the sum of the investment in funds indicated in letters b) and c) of Nº2 and e) of Nº3, administered by the same mutual funds or investment management entity. The Superintendency, through a general rule, may establish diversification limits for issuance, to the investments that support the technical reserves and the risk equity indicated in article 21 of the D.F.L. Nº 251, considering the following ranges: a) Between 10% and 20% of the total of deposits and deposits and of the total of mortgage bills issued by a bank or financial entity, in the case of the instruments of letter b) of 4Nº1; b) Between 20% and 30% of the issue or series, in the case of instruments of letter c) of No. 1; c) Between 10% and 20% of the participation, in the case of instruments of letter d) of Nº1; d) Between 8% and 20% of the total subscribed shares, in the case of instruments of letter a) of Nº2, and e) Between 20% and 30% of the total subscribed subscriptions of a mutual fund or of investment, indicated in letters b) and c) of Nº2 and d) and e) of Nº3. The Superintendency will set the limits indicated for minimum periods of one year, and must inform the modification of these, three months in advance of its validity. If a representative investment of technical reserves or risk assets or a group of them exceeds any of the limits of diversification established in this law, the excess will not be accepted as backup of said reserves or risk equity. Nor will investments that fail to meet the requirements set forth in the law to be representative of technical reserves be accepted. Investments representing technical reserves and risk assets may not be affected by encumbrances, prohibitions, seizures, litigation, precautionary measures, suspensive or resolutive conditions, or be the subject of any other act or contract that prevents their free assignment or transfer.
