Ley No. 146-02, sobre Seguros y Fianzas en la República Dominicana
Capítulo III: De la Autorización para Actuar como Asegurador o Reasegurador
SECCIÓN I DE LOS REQUISITOS PARA LA SOLICITUD DE AUTORIZACIÓN A LOS ASEGURADORES Y REASEGURADORES-COMPAÑÍAS NACIONALES
SECCIÓN IV DE LA SOLICITUD DE AUTORIZACIÓN PARA INICIAR OPERACIONES COMO COMPAÑÍAS EXTRANJERAS ARTICULO
15.- Las compañías o sociedades organizadas conforme a las leyes de otros países que se propongan operar el negocio de seguros, reaseguros, o ambos, en el territorio nacional, con excepción de las autorizadas con anterioridad a la entrada en vigencia de esta ley, formularán su solicitud a la Superintendencia, en la cual expresen el o los ramos en que se propongan operar en el territorio nacional; se acompañará dicha solicitud con los siguientes documentos:
a) Copia autenticada de sus estatutos, o documentos constitutivos vigentes, traducidos al español y tramitados debidamente para su plena validez en la República Dominicana;
b) Certificación relativa al domicilio de la compañía o sociedad, al de su oficina principal y al domicilio en la República Dominicana, el cual debe ser fijado previamente;
c) Balance general y estados de ganancias y pérdidas relativos a sus operaciones durante los últimos cinco (5) años, debidamente aprobados de acuerdo con la legislación de seguros de su país de origen;
d) Certificado de los nombres, domicilio y nacionalidad de sus administradores o directores;
e) Copia autenticada del poder otorgado a favor de su representante legal en la República Dominicana, traducida al español y tramitada debidamente para su plena validez en el país;
f) Certificación del organismo estatal o gubernamental que tenga a su cargo la supervisión de las operaciones efectuadas por las compañías o sociedades de seguros en su país de origen, la cual acredite que la entidad solicitante está organizada y funciona de acuerdo con las leyes y que está autorizada para efectuar las operaciones correspondientes a los ramos de seguros comprendidos en la solicitud. Esta certificación será traducida al español y tramitada debidamente para su plena validez en la República Dominicana;
g) Certificación del acuerdo o de los acuerdos tomados por los organismos competentes de la compañía o sociedad, haciendo constar la decisión tomada para extender sus negocios a la República Dominicana, y que la misma responderá de las obligaciones derivadas de sus operaciones en la República Dominicana, o de la propia ley; con los bienes que posea en el territorio nacional y, además, con los que tenga en otros países hasta donde sus leyes lo permitan; y que se someterá a las leyes, y tribunales dominicanos, en cuanto a los seguros y operaciones efectuados en la República Dominicana, renunciando de manera expresa a todo derecho que a ellos se oponga. Esta certificación deberá traducirse al español y tramitarse debidamente para su plena validez en la República Dominicana;
h) El modelo de las pólizas, de las solicitudes de seguros y de los demás documentos y formularios que se propongan usar para los fines de sus negocios, redactados en español; i) Constancia del depósito en efectivo del capital radicado conforme a esta ley, expedida por las instituciones bancarias depositarias.
SECCIÓN V DE LA SOLICITUD PARA OPERAR NUEVOS RAMOS ARTICULO
16.- Cuando un asegurador o reasegurador registrado desee operar en nuevos ramos de seguros, deberá formular su solicitud a la Superintendencia, expresando en dicha solicitud el nuevo o los nuevos ramos de seguros que se propone operar, acompañándola con los siguientes documentos:
a) Si se trata de un asegurador o reasegurador organizado de acuerdo con las leyes de la República Dominicana:
1) Certificación del acuerdo tomado por sus organismos competentes en la que conste la decisión de operar el nuevo o los nuevos ramos de seguros;
2) Modelo de las pólizas, de solicitudes y demás documentos y formularios que se propongan usar en el nuevo o los nuevos ramos.

Chapter III: Of the Authorization to Act as Insurer or Reinsurer
SECTION IV OF THE APPLICATION FOR AUTHORIZATION TO INITIATE OPERATIONS AS FOREIGN COMPANIES ARTICLE 15.-
The companies or companies organized according to the laws of other countries that intend to operate the insurance, reinsurance business, or both in the national territory, with the exception of those authorized prior to the entry into force of this law, they will make their request to the Superintendency, in which express the branch or branches in which they intend to operate in the national territory; I know will accompany said request with the following documents:
a) Authenticated copy of its statutes, or constituent documents in force, translated into Spanish and duly processed for full validity in the Dominican Republic;
b) Certification relative to the domicile of the company or society, from its main office and domicile in the Republic Dominican, which must be previously fixed;
c) Balance sheet and profit and loss statements related to their operations during the last five (5) years, duly approved in accordance with the insurance legislation of your country of origin;
d) Certificate of the names, address and nationality of their administrators or directors;
e) Authenticated copy of the power of attorney granted in favor of their representative legal in the Dominican Republic, translated into Spanish and duly processed for full validity in the country;
f) Certification of the state or government body that has his position supervising the operations carried out by the insurance companies or companies in their country of origin, which prove that the applicant entity is organized and works in accordance with the laws and that it is authorized to carry out the operations corresponding to insurance lines included in the application. This certification will be translated into Spanish and duly processed for full validity in the Dominican Republic;
g) Certification of the agreement or agreements made by the Competent bodies of the company or society, making record the decision made to extend its business to the Dominican Republic, and that it will answer for the obligations derived from its operations in the Republic Dominican, or of the law itself; with the assets you have in the national territory and, in addition, with those you have in other countries as far as its laws allow; and who will submit to the laws, and Dominican courts, regarding insurance and operations made in the Dominican Republic, resigning express to any right that opposes them. This certification It must be translated into Spanish and duly processed for full validity in the Dominican Republic;
h) The model of the policies, the insurance applications and the other documents and forms that they intend to use for business purposes, written in Spanish;
i) Proof of the cash deposit of the capital settled to this law, issued by depository banking institutions. SECTION V OF THE REQUEST TO OPERATE NEW BRANCHES ARTICLE 16.-
When a registered insurer or reinsurer wishes operate in new branches of insurance, you must make your request to the Superintendency, expressing in said request the new or new lines of insurance proposed operate, accompanying it with the following documents:
a) If it is an organized insurer or reinsurer of according to the laws of the Dominican Republic:
1) Certification of the agreement taken by your organizations competent in which the decision to operate the new or new lines of insurance;
2) Model of the policies, applications and other documents and forms that you intend to use in the new or new bouquets.
